Terms & Conditions
These terms govern your use of The Pocket Arcade Club website, games and memberships. Please read them before joining or buying a game.

1. Who you are contracting with
This website and the games on it are operated by The Pocket Arcade Club ("we", "us", "the Club"). When you use the site, buy a game or hold a membership, you are entering into an agreement with The Pocket Arcade Club. You can reach us at hello@thepocketarcadeclub.com.
2. Accepting these terms
By using the site, creating an account, or buying anything from us, you agree to these terms. If you do not agree with them, please stop using the site. If you are using the Club on behalf of an organisation, you confirm you have authority to accept these terms on its behalf. If you are an individual, you confirm you are old enough to enter into a contract in your country, or have your parent or guardian's permission.
3. What we provide
The Club provides original browser-based games, playable on phones, tablets and computers, and installable as web apps. Some games are always free. Others are unlocked by buying a single game outright or by holding a Club membership. We may add, change or retire games over time, and we may adjust which games are free.
4. Your account
You are responsible for keeping your sign-in details confidential and for everything that happens under your account. Please give us accurate information when you register and keep it up to date. Tell us straight away if you think someone else has access to your account.
5. Acceptable use
You must not misuse the Club. In particular, you must not:
- use the site for anything unlawful, fraudulent or abusive;
- send spam, harass other members, or post offensive names or scores;
- infringe anyone's intellectual property, including by copying, reselling or redistributing our games;
- interfere with the security or operation of the site — no malware, probing, scraping, automated scripts, bots, or attempts to falsify leaderboard scores;
- reverse engineer, decompile or attempt to circumvent any technical limits or payment gates.
We may remove scores, achievements or player card content that we reasonably believe breaks these rules.
6. Licence to play
We grant you a limited, personal, non-exclusive, non-transferable right to play the games included in your purchase or membership, for your own non-commercial enjoyment. You do not own the games; you have permission to play them.
7. Our intellectual property
All software, artwork, sound, logos, branding and written content on the site belong to The Pocket Arcade Club or our licensors and are protected by intellectual property law. Our games are original works inspired by the 1970s pocket handheld era; we are not affiliated with, endorsed by, or connected to Tomy, Palitoy or any other historic manufacturer, and any names referenced are the property of their respective owners.
8. Payment, billing and subscriptions
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment, billing, applicable taxes, renewals, cancellations and refunds are handled under Paddle's Buyer Terms. Memberships renew automatically at the interval you chose (monthly or annually) until cancelled. You can cancel at any time; your access continues until the end of the period you have already paid for. Single-game purchases and the Founding Membership are one-off payments and do not renew. Prices are shown in pounds sterling and may be converted or adjusted for local taxes at checkout. See our Refund Policy for how refunds work.
9. Service availability
We work hard to keep the arcade open, but we cannot guarantee that the site or the games will always be available, uninterrupted or error-free. We may suspend the service for maintenance, updates or reasons beyond our control.
10. Suspension and termination
We may suspend or terminate your access if you materially breach these terms, if payment fails or is reversed, if we detect fraud or a security risk, or if you repeatedly or seriously break our acceptable use rules. You may close your account at any time by contacting us. When your access ends, your saved scores and player card may be deleted.
11. Warranties and liability
To the fullest extent permitted by law, we exclude all implied warranties, including merchantability and fitness for a particular purpose. We are not liable for indirect or consequential loss, including lost profits, data or goodwill. Our total liability to you in any twelve-month period is limited to the amount you paid us in that period. Nothing in these terms limits liability for fraud, death or personal injury caused by negligence, or anything else that cannot be excluded by law. Nothing in these terms affects your statutory rights as a consumer.
12. Indemnity
You agree to indemnify us against claims arising from your unlawful use of the Club, content you submit, or your breach of these terms.
13. Changes to these terms
We may update these terms from time to time. If we make a material change we will let members know by email or a notice on the site. Continuing to use the Club after a change means you accept the updated terms.
14. Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction over any dispute, without affecting any mandatory consumer protections available to you where you live. We may transfer these terms as part of a merger or sale of the business; you may not transfer them without our consent. Neither of us is responsible for failures caused by events beyond our reasonable control.
